The Munich Orff Center, in agreement with the Carl Orff Foundation, has issued the following House Rules:
Article 1: Area of Validity
1) 1These House Rules apply to the use of all collections and works housed in the Orff Center. 2The term "works" refers in particular to manuscripts, letters, sheet music, books, periodicals, microfilms/microfiches, audio-visual materials, and electronic data media.
2) The Orff Center is dedicated to the purposes of scholarship, and above all to the study of Carl Orff and his work for professional and educational purposes.
3) 1Permission to use the Orff Center is granted to all persons who wish to visit its premises for any of the purposes mentioned in item 2 above, provided that this does not conflict with the interests of the Orff Center or the Carl Orff Foundation. 2There is no legally binding right to the use of the Center.
Article 2: Application and Permission to Use
1) 1Permission to use the Orff Center must be applied for in person at the Center. 2Each user must enter his or her name in the visitors' register and identify himself or herself by means of an appropriate document with photograph suitable for photocopying. 3Before permission is granted, users must convincingly describe the purpose of their visit and, if applicable, indicate the name and address of their sponsor or institutional affiliation.
2) 1Permission is granted by the director of the Orff Center or, in his absence, by his representative. 2Users who wish personally to examine the holdings of the Carl Orff Foundation on a larger scale require permission from the Carl Orff Foundation. 3Examination of Carl Orff's correspondence is only permitted with the express consent of the Carl Orff Foundation.
3) Permission may be denied, revoked or made contingent upon stipulations at any time, particularly when
a) the items in the holdings are less than thirty years old,
b) there is reason to believe that third-party interests deserving of protection may be infringed,
c) the physical condition of the works might be endangered, or
d) the user offers no assurance that he or she will adhere to these House Rules.
4) The Orff Center is authorized to carry out security checks and especially to examine objects brought onto the premises.
Article 3: Utilization
1) 1The term "utilization" refers to the examination of materials on the premises of the Orff Center or the receipt of information during visiting hours. 2As a rule, materials may be examined only in the form of photocopies, microfilms, or microfiches. 3Original documents may only be viewed in special instances, and then only under supervision and upon previous application. 4While working with original materials, users are only permitted to employ paper, pencil, and laptops or notebooks; fountain pens, felt-tip pens, highlighters, and similar writing implements are prohibited. 5The Center does not have a lending policy.
2) 1Fees are charged for the provision of photographic reproductions. 2Reproduction of original documents is permitted only in well-grounded exceptional instances and only by the Orff Center; users do not have a legally binding right to receive reproductions. 3Requests to reproduce materials from the holdings of the Carl Orff Foundation must be approved by the Foundation beforehand. 4 Users are obligated to use reproductions of original documents only for the stated purposes and are not allowed to pass them on or make them available to third parties.
Article 4: Need to Show Proper Care and Liability for Damages
1) 1Users are obligated to treat the works and collections with care and to protect them from damage. 2The term "damage" also covers handwritten entries of any sort, including underlining, the correction of errors, and the creasing of pages. 3Documents must be left in the order in which they were found, even when the user detects irregularities. 4The Orff Center will be happy to receive references to deficiencies and mistakes in attribution or classification.
2) 1Users must examine the state of each work upon receipt and report any existing damages immediately. If they do not, it will be assumed that they received the work in undamaged condition.
3) 1Lost or damaged works must be replaced at the user's expense, even if the user is not at fault. 2The Orff Center determines the type of compensation according to its own best judgment, possibly in consultation with the Carl Orff Foundation insofar as the damaged property belongs to the Foundation. 3In particular, the Center may ask the user to restore the work to its previous condition, to provide a replacement at his or her expense, to obtain another work of comparable value or a reproduction, or to pay an appropriate amount of money in compensation. 4The Center may also ask the user to compensate for any loss of value left uncovered by the above-mentioned measures.
4) 1Users are obligated to honor any and all third-party rights pertaining to the collection of the Orff Center and in particular to obtain any necessary rights of publication. 2They are held liable for any damages resulting from the violation of copyright, privacy, or other rights and are obligated to release the Orff Center from any payment of damages in connection with such violations.
Article 5: Liability
Only in the case of premeditation or gross negligence does the Orff Center accept liability for claims arising from the use of its premises.
Article 6: Publications
1) 1Publications which draw on the holdings of the Orff Center must mention the name of the Center at an appropriate location. 2The same applies to the Carl Orff Foundation with regard to publications drawing on the holdings of the Carl Orff Foundation. 3Reproduction of items from the holdings require a special agreement and may be made contingent on payment of a fee or equivalent gesture in return; Rights of publication may not be transferred to third parties without the written consent of the Orff Center.
2) A free complimentary copy must be given to the Orff Center for any publication which makes extensive use of original documents from its holdings.
